LOS ANGELES CAP) – A j u d ge threw out part of a lawsuit by singer and actress Martha  Raye , who claims Bette Midler ripped off her l i fe story for the movie “For the Boys.”
Superior Court Judge Jerry Fields dismissed all claims except breach of contract and set trial for Dec. 6, said Mary Banies, a lawyer for Miss Midler, 20th Century Fox and the
movie’s producer and director.Miss Raye sued for $5 million last year, claiming breach of contract, fraud and negligence. She claimed to have offered to sell her life story to Miss Midler several years ago for $1 million.
Miss Raye’s attorney, Richard Ferko, wasn’t available for comment, a secretary said.
