LOS ANGELES CAP) – A j u d geÂ threw out part of a lawsuit byÂ singer and actressÂ MarthaÂ Â RayeÂ , who claims Bette MidlerÂ ripped off her l i fe story for theÂ movie “For the Boys.”
Superior Court Judge JerryÂ Fields dismissed all claims except breach of contract and setÂ trial for Dec. 6, said MaryÂ Banies, a lawyer for Miss Midler, 20th Century Fox and the
movie’s producer and director.Miss Raye sued for $5 millionÂ last year, claiming breach of contract, fraud and negligence. SheÂ claimed to have offered to sell herÂ life story to Miss Midler severalÂ years ago for $1 million.
Miss Raye’s attorney, RichardÂ Ferko, wasn’t available for comment, a secretary said.
